Terms of Service

Welcome to BLDit.ca (the “Site”), operated by BLDit Inc. (“BLDit”, “we”, “us”, or “our”), located at 202-1457 McCowan Road, Toronto, Ontario, M1S 5K7. These Terms of Service (“Terms”) govern your use of our platform and services.

By using this Site, you agree to these Terms. If you do not agree, you must not access or use the Site.

1. Eligibility

To use BLDit.ca and access our Services, you must be at least 18 years of age and possess the legal capacity to enter into binding contracts under the laws applicable in your jurisdiction. By accessing or using the Site, you represent and warrant that:

  • You are of legal age to form a binding contract;
  • You are not barred from using the Services under any applicable laws or regulations;
  • All information you provide is accurate, complete, and current;
  • You will use the Site and Services solely for lawful purposes and in accordance with these Terms.

If you are using the Site on behalf of a company, partnership, or other legal entity, you further represent that you have the legal authority to bind that entity to these Terms, and that both you and the entity will comply with all applicable laws.

BLDit reserves the right to refuse access to the Services, suspend or terminate user accounts, or restrict features to any individual or entity that does not meet the eligibility requirements, or where use of the Services would violate any laws or regulations.

2. Our Services

BLDit provides an interactive, user-centric digital platform that enables homeowners and property managers to engage in streamlined home renovation planning and execution. Through our platform, users are able to:

  • Plan and design room-by-room renovations using intuitive tools that guide layout selection, functional design choices, and space optimization strategies;
  • Choose finishes, materials, and configurations from a curated selection of vetted suppliers, ensuring quality, compatibility, and aesthetic alignment with the user’s renovation goals;
  • Receive transparent pricing based on the products, services, and configurations selected, with a detailed breakdown of costs to promote budgeting clarity and minimize surprise charges;
  • Coordinate with licensed, insured, and verified contractors in the user’s geographic region to implement the renovation project from start to finish.

BLDit acts as a facilitator between users and third-party service providers, including contractors and suppliers. While we strive to ensure a smooth experience, BLDit does not directly perform renovation work and is not a party to any construction or service contract entered into between users and contractors.

We continually update and enhance our platform. Accordingly, we reserve the right to modify, suspend, or discontinue any part of the Site, its features, or the Services we offer, at any time and without prior notice. This may include changes to pricing models, design interfaces, availability of certain contractors or products, or other functional adjustments.

BLDit shall not be liable to users or any third party for any such modification, suspension, or discontinuance of Services. We recommend that users regularly review the platform and associated documentation to stay informed of any updates.

3. Account Registration

To access certain features of the Site and utilize the full scope of BLDit’s Services—including saving renovation plans, selecting materials, and engaging contractors—you may be required to register for an account.

By creating an account, you agree to:

  • Provide accurate, complete, and current information during the registration process;
  • Keep your login credentials (such as your username and password) confidential and secure;
  • Be solely responsible for all activities that occur under your account, whether or not authorized by you;
  • Notify BLDit immediately at info@bldit.ca of any unauthorized use, suspected breach of security, or misuse of your account.

You may not:

  • Share your account with any third party;
  • Create more than one account unless expressly authorized;
  • Use another user’s account or impersonate another individual or entity.

BLDit reserves the right to suspend or terminate your account at any time and without liability if we believe that you have violated these Terms, engaged in fraudulent activity, or otherwise misused the Site or Services.

Users are responsible for ensuring that their contact and billing information is kept up to date. BLDit is not liable for any losses or damages resulting from unauthorized access or user negligence in maintaining account security.

4. User Conduct

By accessing or using the Site and Services, you agree to use them responsibly, ethically, and in compliance with all applicable laws. Without limiting the generality of the foregoing, you agree that you will not:

  • Use the Site for any unlawful, fraudulent, or malicious purpose, including but not limited to violating local, provincial, national, or international laws or regulations;
  • Impersonate any person or entity, or falsely represent your affiliation with any person, organization, or business;
  • Access, tamper with, or use non-public areas of the Site, or attempt to gain unauthorized access to other user accounts, computer systems, or networks connected to the Site through hacking, password mining, or any other illegitimate means;
  • Interfere with the operation, integrity, or security of the Site, including transmitting any viruses, malware, worms, Trojan horses, or other harmful code;
  • Upload, post, transmit, or otherwise make available any content that is defamatory, obscene, abusive, threatening, invasive of privacy, misleading, offensive, discriminatory, or otherwise objectionable;
  • Post or transmit any content that infringes upon or violates the intellectual property rights, privacy rights, publicity rights, or other proprietary rights of any third party;
  • Collect or store personal data about other users without their express consent, or use the platform for unsolicited commercial messages, advertising, or spam;
  • Use any automated system or software (e.g., bots, scrapers, or spiders) to access or extract data from the Site without express written consent from BLDit.

We reserve the right to monitor your use of the Site and to remove or disable access to any content or account that violates these Terms, without prior notice.

Violation of these provisions may result in suspension or termination of your account, legal action, or other remedies available to BLDit under law.

5. Payments and Quotes

BLDit aims to provide clear and transparent pricing to help users make informed decisions when planning and executing renovation projects. However, all cost estimates displayed on the platform—whether for materials, labour, or full project scope—are non-binding and subject to change based on product availability, contractor rates, design modifications, or unforeseen project variables.

a) Quotes and Pricing

All prices shown on the platform, including for materials and service packages, are estimates only and may fluctuate until formally confirmed.

A final project quote will be provided once all selections are finalized and prior to the commencement of work. This final quote may include taxes, delivery fees, contractor charges, and any other applicable costs.

BLDit does not guarantee price matching or fixed pricing for any extended period unless otherwise agreed in writing.

b) Payment Terms

By proceeding with a renovation project, you agree to the payment terms set out in the final quote or project agreement, which may include deposits, milestone-based payments, or payment upon completion.

Failure to pay in accordance with the agreed terms may result in project delays, suspension of services, or legal action to recover outstanding amounts.

You are responsible for providing valid and up-to-date payment information and authorizing any charges incurred under your account.

c) Third-Party Fees

Certain transactions may be processed by third-party payment processors. You agree to comply with the terms of service of any such processor and acknowledge that BLDit is not responsible for any errors or disputes arising from payment processing.

d) Refunds and Cancellations

Refunds or cancellations are subject to the terms outlined in your project-specific agreement or invoice. In general, deposits may be non-refundable once work has commenced or materials have been ordered.

If a contractor withdraws from a project for reasons beyond your control, BLDit will make reasonable efforts to assist in replacing the contractor, but does not guarantee project continuity or refunds beyond what is contractually obligated.

6. Contractor Relationships

BLDit functions as a digital intermediary that connects users with third-party renovation contractors for the purpose of carrying out residential renovation projects. These contractors include general contractors, subcontractors, designers, and other service providers (collectively, “Contractors”).

a) Independent Contractors

All Contractors accessible through the BLDit platform operate as independent third parties. They are not employees, agents, or affiliates of BLDit. Accordingly, BLDit does not supervise, direct, or control the manner in which Contractors perform their services.

b) Due Diligence

While BLDit makes reasonable efforts to verify the background, insurance, and licensure status of Contractors before listing them on the platform, we do not guarantee or warrant the accuracy, reliability, quality, safety, or legality of any services performed. It is the sole responsibility of the user to assess the suitability and credentials of any Contractor they choose to engage.

c) No Warranty or Endorsement

BLDit does not:

  • Guarantee the quality or outcome of any work performed;
  • Endorse any specific Contractor;
  • Mediate contractual disputes between users and Contractors;
  • Bear liability for any damages, injuries, losses, delays, or deficiencies caused by or associated with a Contractor's work.

d) Direct Engagement

Any agreement, payment arrangement, project scope, or warranty related to work performed by a Contractor is between you and the Contractor directly. Users are advised to:

  • Enter into written contracts for clarity;
  • Confirm that all necessary permits, insurance, and municipal approvals are obtained;
  • Keep records of communications, payments, and timelines.

e) Risk Acknowledgement

By engaging a Contractor through the BLDit platform, you acknowledge and accept the risks associated with contracting for renovation work, including but not limited to cost overruns, construction delays, material shortages, and workmanship disputes.

7. Intellectual Property

All content, software, features, functionality, and materials available on or through the Site—including but not limited to text, graphics, images, photographs, illustrations, layout, logos, service marks, product names, icons, design elements, videos, audio clips, documents, downloadable materials, and underlying code (collectively, the “Content”)—are the exclusive property of BLDit Inc. or its licensors, and are protected by Canadian and international intellectual property laws, including copyright, trademark, trade secret, and patent laws.

a) Ownership and Restrictions

All right, title, and interest in and to the Site and its Content remain with BLDit and/or our licensors.

Nothing in these Terms grants you any ownership rights or licenses to the Content, except the limited, revocable license explicitly granted below.

b) Limited License

Subject to your compliance with these Terms, BLDit grants you a personal, non-exclusive, non-transferable, and limited license to access and use the Site solely for your own internal and non-commercial use related to planning or managing a renovation project through BLDit.

You may not:

  • Reproduce, modify, adapt, translate, publish, transmit, distribute, display, sell, license, or create derivative works from any part of the Site or its Content;
  • Use any data mining, scraping, bots, or similar data gathering or extraction methods on the Site;
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of any software on the Site;
  • Use the BLDit name, trademarks, or logos without express written authorization.

c) Trademarks

All trademarks, service marks, logos, and trade names used on the Site, including “BLDit” and any related branding elements, are registered or unregistered trademarks owned by BLDit or its affiliates. Unauthorized use of these marks is strictly prohibited and may violate intellectual property laws.

d) Third-Party Content

Some content on the Site may be owned by third parties and licensed to BLDit. Such content is subject to the same restrictions and protections as described above, and any use inconsistent with those restrictions is prohibited.

8. User Content

As part of your use of BLDit.ca, you may be permitted or invited to submit, upload, or share content through the platform, including but not limited to photos of your property, design preferences, material selections, project feedback, reviews, ratings, comments, testimonials, and other user-generated materials (collectively, “User Content”).

a) Ownership and License

You retain full ownership of any User Content you submit. However, by uploading or submitting User Content to the Site, you grant BLDit a non-exclusive, royalty-free, worldwide, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, display, and distribute such content in connection with:

  • Operating and improving the Site and Services;
  • Marketing and promotional purposes (unless explicitly opted out);
  • Displaying design samples, showcasing renovations, or demonstrating platform features.

This license continues for as long as your content remains published on the platform or archived in connection with completed Services.

b) User Responsibilities

By submitting User Content, you represent and warrant that:

  • You own the content or have the necessary rights, permissions, and licenses to submit and grant the rights set forth herein;
  • Your content does not infringe, misappropriate, or violate any third-party rights, including copyright, trademark, privacy, publicity, or other proprietary rights;
  • Your content is accurate, lawful, and not misleading, defamatory, obscene, harassing, abusive, or otherwise objectionable;
  • Your content complies with all applicable laws and regulations.

You are solely responsible for the content you post, and BLDit assumes no liability for any content submitted by users.

c) Moderation and Removal

BLDit reserves the right—but not the obligation—to monitor, review, edit, or remove any User Content at its sole discretion and without prior notice, including where content:

  • Violates these Terms;
  • Infringes on third-party rights;
  • Is harmful, offensive, or unlawful;
  • Pose a risk to the integrity or security of the platform.

BLDit also reserves the right to suspend or terminate any user account associated with repeated or egregious content violations.

9. Limitation of Liability

To the maximum extent permitted by applicable law, BLDit Inc., its affiliates, directors, officers, employees, contractors, licensors, and agents (collectively, “BLDit Parties”) shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to:

  • Loss of profits, revenue, or business opportunities;
  • Loss of data, personal property, or goodwill;
  • Personal injury, property damage, or construction delays;
  • Service interruptions, platform outages, or data loss;
  • Claims arising from third-party contractors or service providers.

These limitations apply regardless of the legal theory under which such damages are claimed—whether in contract, tort (including negligence), equity, or otherwise—and even if BLDit has been advised of the possibility of such damages.

a) No Warranty of Continuous Availability

BLDit does not warrant that:

  • The Site or Services will be uninterrupted, secure, or error-free;
  • Any content, data, or information provided will be accurate or up to date;
  • Any technical defects will be corrected in a timely manner or at all;
  • The Site is free of viruses, malware, or harmful components.

You use the Site and Services at your own risk. BLDit provides all content and functionality on an “as is” and “as available” basis, without warranties or conditions of any kind, express or implied.

b) Maximum Liability Cap

In any event, BLDit’s total aggregate liability to you for any claims arising out of or relating to these Terms, the use of the Site, or the Services shall be strictly limited to the greater of (i) one hundred Canadian dollars ($100 CAD) or (ii) the total amount you paid to BLDit, if any, in the six (6) months preceding the event giving rise to the claim.

c) Jurisdictional Exceptions

Because some jurisdictions do not allow the exclusion or limitation of certain damages or warranties, some of the above limitations may not apply to you. In such cases, BLDit’s liability will be limited to the fullest extent permitted by applicable law.

10. Termination

BLDit reserves the right to suspend, deactivate, or permanently terminate your account and/or restrict or revoke your access to the Site and Services, at any time and at our sole discretion, for any reason, including but not limited to:

  • A breach or violation of these Terms of Service, our Privacy Policy, or any other policy or agreement applicable to the use of the Site;
  • Fraudulent, abusive, or illegal activity;
  • Submission of false or misleading information;
  • Interference with the functionality, security, or integrity of the Site or Services;
  • Behavior that is harassing, abusive, or harmful to BLDit, our staff, service providers, or other users.

a) Effect of Termination

Upon termination:

  • Your right to use the Site and any associated Services will immediately cease;
  • Your account may be deleted, along with any data, project history, or files stored in connection with it;
  • Any licenses granted to you under these Terms will immediately be revoked;
  • Any obligations owed to BLDit prior to termination (e.g., outstanding payments) will remain enforceable.

BLDit is not liable for any loss of access, data, or opportunity resulting from a suspension or termination of your account. It is your responsibility to maintain backup copies of any data or information you store on the platform.

b) Voluntary Termination

You may terminate your account at any time by contacting us at info@bldit.ca. Termination will not relieve you of any financial obligations incurred prior to closure or entitle you to any refund of fees paid, unless expressly provided in writing.

c) Survival of Terms

The following provisions shall survive any termination of your use of the Site or Services: Intellectual Property, User Content, Limitation of Liability, Indemnity, Governing Law, and any other provisions which by their nature are intended to survive termination.

11. Privacy

Your privacy is important to us. BLDit is committed to protecting the personal information of users in accordance with applicable Canadian privacy legislation, including the Personal Information Protection and Electronic Documents Act (PIPEDA).

By using the Site or Services, you acknowledge and agree that BLDit may collect, use, store, and disclose your personal information as described in our Privacy Policy, which forms an integral part of these Terms.

a) Types of Information Collected

We may collect a range of personal and non-personal information, including but not limited to:

  • Contact details (e.g., name, email address, phone number, home address);
  • Project-related data (e.g., renovation preferences, property photos, measurements);
  • Billing and payment information;
  • Technical and usage data (e.g., IP address, browser type, session logs, cookies).

b) Purpose of Collection

Your information may be used for purposes including:

  • Creating and managing your account;
  • Providing and personalizing Services;
  • Processing payments and sending invoices;
  • Communicating project updates and promotional offers;
  • Ensuring security, fraud prevention, and legal compliance;
  • Improving the Site and user experience.

c) Disclosure to Third Parties

We may disclose your personal data to:

  • Contractors or service providers working on your renovation project;
  • Third-party payment processors for transaction purposes;
  • Technology partners who support our platform infrastructure;
  • Legal authorities, regulators, or as otherwise required by law.

We do not sell or rent your personal data to third parties for commercial purposes.

d) User Rights

You have the right to:

  • Access your personal information;
  • Request corrections or deletions;
  • Withdraw consent (subject to legal or contractual restrictions);
  • Lodge a complaint with a privacy regulator if you believe your rights have been violated.

e) Data Security

We implement reasonable administrative, technical, and physical safeguards to protect your information from unauthorized access, disclosure, or misuse. However, no system is entirely secure, and BLDit makes no guarantees regarding the absolute security of your data.

12. Governing Law

These Terms of Service, as well as any disputes, claims, or causes of action arising out of or related to your use of the Site or Services (whether in contract, tort, equity, or otherwise), shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws principles.

a) Jurisdiction and Venue

You irrevocably agree that any legal action, proceeding, or dispute resolution arising under or relating to these Terms or the use of the Site or Services shall be brought exclusively before the courts located in Toronto, Ontario, Canada. You further consent to the personal jurisdiction of such courts and waive any right to object to venue or to claim forum non conveniens.

b) No Class Actions

To the extent permitted by applicable law, you agree that any proceedings to resolve or litigate any dispute shall be conducted solely on an individual basis. You agree not to bring any claim as a plaintiff or class member in a class, consolidated, or representative action.

c) Compliance with Local Laws

Although the platform is accessible across jurisdictions, it is primarily intended for users in Canada. Users accessing the Site from outside Canada do so at their own risk and are responsible for compliance with the laws of their local jurisdiction, to the extent they apply.

d) Statutory Consumer Protections

If you are a consumer under applicable law, you may have additional rights under mandatory consumer protection legislation in your jurisdiction, and nothing in these Terms shall limit those rights where such laws apply.

13. Modifications

BLDit reserves the right to update, revise, modify, or amend these Terms of Service at any time and for any reason, in whole or in part, at our sole discretion. Such modifications may reflect changes in applicable laws, updates to our business practices, enhancements to the Site or Services, or other operational or legal considerations.

a) Notice of Changes

When we make material changes to these Terms, we will:

  • Post the updated Terms on this page with a new “Effective Date” at the top;
  • Where required by law or in our discretion, provide additional notice (e.g., via email or a banner notification on the Site).

You are responsible for regularly reviewing the Terms to stay informed of any updates.

b) Your Continued Use

By continuing to access or use the Site or Services after any changes to the Terms are posted, you are deemed to have accepted and agreed to be bound by the revised Terms. If you do not agree to the modified Terms, you must immediately discontinue use of the Site and Services and, if applicable, close your account.

c) Version Control

For historical reference or legal purposes, BLDit may retain archives of previous versions of these Terms, which are available upon request.
